These Terms of Service (“Terms”) govern your access to and use of the websites, software, tools, content, integrations, and services provided by Home Service Growth (“Home Service Growth,” “we,” “us,” or “our”).

By accessing or using Home Service Growth, you agree to these Terms. If you use the service on behalf of a business, you represent that you have authority to bind that business to these Terms.

Our Services

Home Service Growth provides software and related services for home service businesses, including websites, lead capture forms, contact and customer management, scheduling tools, job management, estimates, invoices, email automations, analytics, media tools, SEO-related tools, integrations, and other business growth features.

We may add, modify, suspend, or discontinue features at any time.

Accounts and Eligibility

You must be able to enter into a binding agreement to use Home Service Growth. You are responsible for maintaining accurate account information, protecting your login credentials, and all activity that occurs under your account.

You agree to notify us promptly if you believe your account has been accessed without authorization.

Acceptable Use

You agree to use Home Service Growth only for lawful business purposes.

You may not use the service to violate any law, infringe another party’s rights, send spam or deceptive communications, upload harmful code, interfere with platform operations, attempt unauthorized access, reverse engineer the service, scrape or copy the platform, or use the service in a way that harms Home Service Growth, our customers, or other users.

Customer Content and Data

You retain ownership of the content, files, business information, customer records, form submissions, images, service descriptions, estimates, invoices, job details, and other materials you submit to Home Service Growth.

You grant Home Service Growth permission to host, store, process, transmit, display, back up, and use that content as needed to provide, maintain, secure, and improve the service.

You are responsible for ensuring that you have the rights and permissions needed to submit and use your content through the platform.

Websites and Published Content

If Home Service Growth creates, hosts, or powers a website for your business, you are responsible for reviewing and approving the content published on that website, including service descriptions, pricing references, claims, testimonials, images, contact information, business details, legal pages, and compliance with applicable laws.

We may provide templates, generated content, stock assets, suggested copy, SEO content, or other materials, but you are responsible for confirming that the final published content is accurate and appropriate for your business.

Leads, Customers, Estimates, and Invoices

Home Service Growth may help you collect leads, manage contacts, schedule work, create jobs, prepare estimates, issue invoices, and track customer activity.

You are responsible for the accuracy of your pricing, taxes, payment terms, service terms, estimates, invoices, job information, customer communications, and business records.

Home Service Growth does not provide legal, tax, accounting, financial, or professional trade advice.

Email and Automated Communications

The platform may allow you to send notifications, auto-responses, lead nurture emails, review requests, and other communications.

You are responsible for ensuring that your communications comply with applicable laws, including laws related to marketing, consent, unsubscribe requests, and electronic communications.

We may suspend or limit messaging features if we believe they are being misused or may create legal, deliverability, security, or platform risk.

Third-Party Services and Integrations

Home Service Growth may integrate with third-party services, including payment processors, email providers, hosting providers, analytics tools, Google services, QuickBooks, domain providers, search tools, and other business software.

Third-party services are not controlled by Home Service Growth. Your use of third-party services may be subject to separate terms, fees, privacy policies, limits, and availability.

We are not responsible for third-party service outages, errors, data practices, changes, or failures.

Billing and Payment

If you purchase paid services, you agree to pay all fees, charges, taxes, and renewal amounts presented at checkout, in your account, or otherwise agreed in writing.

Subscriptions may renew automatically unless canceled according to the applicable billing process. Payments may be processed by third-party payment providers.

Unless otherwise stated in writing or required by law, fees are non-refundable once the applicable service period begins.

We may suspend or terminate access to paid services if payment is not received, payment fails, or billing information is inaccurate.

No Guarantee of Results

Home Service Growth is designed to help home service businesses improve their websites, lead management, customer follow-up, and online operations.

We do not guarantee specific results, including search rankings, website traffic, lead volume, conversion rates, revenue, reviews, customer acquisition, or business growth.

Intellectual Property

Home Service Growth owns or licenses the platform, software, design, workflows, systems, templates, branding, trademarks, documentation, and other materials that make up the service.

These Terms do not transfer ownership of Home Service Growth intellectual property to you. You may not copy, resell, reproduce, modify, distribute, or create derivative works from the platform except as expressly allowed by us in writing.

Feedback

If you provide suggestions, ideas, requests, or feedback, you allow Home Service Growth to use that feedback without restriction or compensation.

Confidentiality

You may receive access to non-public information about Home Service Growth, including product plans, pricing, systems, business processes, or technical information. You agree not to disclose confidential information except as required to use the service or as required by law.

Service Availability

We work to keep Home Service Growth available and reliable, but we do not guarantee uninterrupted access. The service may be unavailable due to maintenance, updates, outages, third-party failures, security issues, or events outside our control.

Suspension and Termination

We may suspend or terminate your access to the service if you violate these Terms, fail to pay amounts owed, create legal or security risk, misuse the platform, or use the service in a way that may harm Home Service Growth or others.

You may stop using the service at any time. Certain obligations will continue after termination, including payment obligations, ownership terms, confidentiality, disclaimers, limitations of liability, indemnification, and dispute provisions.

Disclaimers

Home Service Growth is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

We do not guarantee that the service will be error-free, secure, uninterrupted, or free from harmful components.

Limitation of Liability

To the fullest extent permitted by law, Home Service Growth and its owners, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost goodwill, business interruption, or service interruption.

To the fullest extent permitted by law, our total liability for any claim related to the service or these Terms will not exceed the amount paid by you to Home Service Growth for the service during the twelve months before the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Home Service Growth and its owners, employees, contractors, affiliates, licensors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from your use of the service, your content, your business operations, your violation of these Terms, your violation of law, or your violation of another party’s rights.

Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date above. Your continued use of Home Service Growth after updated Terms are posted means you accept the updated Terms.
